OVERVIEW
Welcome to SNOWVEX™. The terms “we,” “us,” and “our” refer to SNOWVEX™.
SNOWVEX™ operates this online store and website, including all related information, content, features, tools, products and services, in order to provide customers with a curated shopping experience (the “Services”). SNOWVEX™ is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced in these Terms, describe your rights and responsibilities when using the Services.
Please read these Terms carefully before using our website or placing an order. They contain important information concerning purchases, payments, shipping, returns, warranties, intellectual property and limitations of liability.
By accessing or using the Services, you agree to these Terms and our Privacy Policy [LINK], except to the extent that applicable consumer protection law gives you rights that cannot legally be excluded or limited.
If you do not agree with these Terms, you should not use or access the Services.
Nothing in these Terms is intended to exclude, restrict or waive any consumer right that cannot legally be excluded, restricted or waived under the laws applicable to you.
SECTION 1 – ACCESS AND ACCOUNT
You must be at least the age of majority applicable in your place of residence to enter into a purchase contract with SNOWVEX™, unless applicable law permits a minor to make the purchase.
If you allow a minor to access the Services using a device that you own or control, you are responsible for supervising that use where required by applicable law.
To use certain features of the Services or place an order, you may be asked to provide information such as your email address, billing information, payment information and shipping address.
You agree that information you provide to us is accurate, current and complete and that you have the necessary rights to provide it.
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account, except where applicable law provides otherwise.
You may not sell, transfer or assign your account to another person without our prior written consent.
SECTION 2 – OUR PRODUCTS
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colours and other information displayed on the Services are accurate.
However, colours and appearance may vary depending on your device, screen settings and other technical factors.
Minor variations in appearance, texture, packaging or manufacturing may occur and do not necessarily constitute a defect where permitted by applicable law.
Product descriptions, specifications, availability and pricing may be updated from time to time.
We reserve the right to discontinue products or limit quantities where permitted by applicable law.
Nothing in this section limits any mandatory statutory rights you may have regarding conformity, quality, safety, guarantees or warranties.
SECTION 3 – ORDERS
When you submit an order, you are requesting to purchase the products identified in your order.
Your order will be accepted when we send you an order confirmation, unless applicable law provides otherwise.
We may decline or cancel an order in limited circumstances, including where a product is unavailable, a pricing or listing error has occurred, payment cannot be authorized, fraud is reasonably suspected, or shipping restrictions prevent fulfillment.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order using the original payment method, subject to applicable law.
You are responsible for reviewing your order details before submitting the order.
Your purchase is subject to our Refund and Returns Policy [LINK], together with any mandatory consumer rights applicable in your country or region.
Unless applicable law permits otherwise, products purchased through the Services are intended for personal or household use and not for unauthorized commercial resale.
SECTION 4 – PRICES AND BILLING
Prices, discounts and promotions may change from time to time.
The price applicable to your purchase will be the price displayed at the time your order is submitted, except where applicable law requires otherwise.
Where required by applicable law, prices displayed to consumers will include applicable taxes and mandatory charges.
Any shipping, customs, import duties or other charges will be disclosed before purchase where legally required.
For international orders, additional customs duties, import taxes or similar charges may apply depending on the destination country. Responsibility for such charges will be determined in accordance with applicable law and the information provided at checkout.
Promotional offers may be subject to additional terms. Where promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion, subject to mandatory consumer law.
You agree to provide accurate billing, payment and contact information.
You represent that you are authorized to use the payment method provided.
SECTION 5 – SHIPPING AND DELIVERY
We provide estimated shipping and delivery information during the purchasing process where available.
Delivery dates and timeframes are estimates unless a specific delivery date has been expressly agreed or guaranteed.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, customs procedures, weather events, strikes, natural disasters and other events beyond our reasonable control.
However, nothing in this section excludes or limits any statutory delivery rights that apply to your purchase.
For consumers in the European Union, applicable consumer law may require delivery within the agreed period or, where no delivery period has been agreed, within the legally applicable period.
Responsibility for loss or damage to products remains with SNOWVEX™ until the products are delivered to you or to a person designated by you, except where applicable law provides otherwise.
If you arrange your own independent carrier that was not offered by SNOWVEX™, responsibility may transfer in accordance with applicable law once the carrier takes possession of the goods.
SECTION 6 – INTELLECTUAL PROPERTY
The Services and their contents, including trademarks, logos, text, graphics, photographs, videos, product descriptions, product reviews, designs, layouts and other materials, are owned by SNOWVEX™, its affiliates or licensors and are protected by applicable intellectual property laws.
You may access and use the Services for personal, lawful and non-commercial purposes.
You may not reproduce, distribute, modify, publicly display, republish, create derivative works from, sell or commercially exploit our content without prior written permission, except where applicable law permits such use.
Nothing in these Terms grants you ownership or a licence to use SNOWVEX™ trademarks, logos or other intellectual property except as expressly permitted.
SNOWVEX™ names, logos, product names, designs and slogans may constitute trademarks of SNOWVEX™ or its licensors.
Shopify names, logos and trademarks belong to Shopify.
All other third-party names and trademarks belong to their respective owners.
SECTION 7 – OPTIONAL THIRD-PARTY TOOLS
The Services may provide access to tools or functionality supplied by third parties.
These tools may be provided “as is” and “as available” by the relevant third-party provider.
SNOWVEX™ does not control third-party tools and is not responsible for the independent operation of those tools, except where applicable law provides otherwise.
Your use of third-party tools may also be subject to the third party’s own terms and privacy policies.
New features, tools and resources may be added to the Services in the future and may be subject to these Terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain links or functionality provided by third parties.
We do not control third-party websites and are not responsible for their content, availability, privacy practices or terms.
If you choose to access a third-party website, you do so subject to that third party’s terms and policies.
Any transaction you conduct with a third party is between you and that third party.
This section does not limit any liability that cannot legally be excluded.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
SNOWVEX™ is powered by Shopify, which enables us to provide the Services.
Your purchase of products through our Store is made directly with SNOWVEX™.
Shopify is not the seller of products purchased through our Store and is not responsible for the transaction between you and SNOWVEX™, except where applicable law provides otherwise.
Nothing in these Terms is intended to exclude or limit any rights or remedies you may have against Shopify or SNOWVEX™ that cannot legally be excluded or limited.
SECTION 10 – PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy [LINK].
Because our Services are powered by Shopify, Shopify may process certain information relating to your use of the Services.
Information may also be processed by service providers, payment processors, shipping providers and other partners involved in operating the Store.
Such processing may take place in countries outside your country of residence.

SECTION 11 – FEEDBACK AND REVIEWS
If you voluntarily submit reviews, comments, photographs, videos, suggestions or other content to SNOWVEX™ (“Feedback”), you grant SNOWVEX™ a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish, adapt and distribute that Feedback for purposes related to operating, improving and promoting the Services, subject to applicable law.
You retain ownership of your Feedback.
You represent that you have the necessary rights to submit the Feedback and that it does not unlawfully infringe the rights of another person.
You must not submit false, misleading, unlawful, defamatory, abusive, obscene or infringing content.
We may moderate, refuse, edit or remove Feedback where reasonably necessary, including where it violates applicable law, these Terms or the rights of another person.
Where a review or testimonial is connected to compensation, incentives or another material relationship, we may require appropriate disclosure.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates or availability.
We may correct such errors and update information where appropriate.
If an error materially affects an order that you have already placed, we will provide any notice, cancellation or refund required by applicable law.
Nothing in this section allows SNOWVEX™ to retroactively remove rights that have already arisen under applicable consumer law.

You may use the Services only for lawful purposes.
You must not use the Services:

Nothing in this section prohibits lawful activities that cannot legally be restricted.
We may suspend or terminate access where reasonably necessary due to unlawful activity, fraud, abuse, security risks or material violations of these Terms, subject to applicable law.
SECTION 14 – AUTOMATED AGENTS
If you use an automated agent, bot or software to access or interact with the Services, you must ensure that the activity:

SECTION 15 – TERMINATION
We may suspend or terminate your access to the Services where permitted by applicable law if you materially violate these Terms, engage in fraudulent or unlawful activity, or create a security or operational risk.
Termination does not affect rights or obligations that arose before termination.
Provisions concerning intellectual property, privacy, feedback, limitations of liability, dispute resolution and any other provisions that by their nature should survive termination will continue to apply.
Nothing in this section affects mandatory consumer rights relating to purchases already made.
SECTION 16 – DISCLAIMER OF WARRANTIES
The Services are provided for general informational and commercial purposes.
We make reasonable efforts to maintain accurate information, but we do not guarantee that every part of the Services will always be uninterrupted, error-free or available.
Except where expressly provided by SNOWVEX™ or required by applicable law, the Services may be provided on an “as available” basis.
Nothing in these Terms excludes or limits statutory warranties, legal guarantees, conformity rights, product safety rights or other mandatory consumer protections applicable to you.
Where applicable law provides mandatory remedies for defective, unsafe or non-conforming products, those remedies remain available to you.
SECTION 17 – LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, SNOWVEX™, its affiliates, employees, contractors, service providers and licensors will not be liable for indirect, incidental, special or consequential losses arising from your use of the Services.
However, nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
This includes, where applicable, liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, defective or unsafe products, breach of mandatory consumer rights, or any other liability that cannot legally be excluded or limited.
For consumers, these Terms do not reduce any statutory remedies available under applicable consumer protection legislation.
SECTION 18 – INDEMNIFICATION
Where permitted by applicable law, you agree to indemnify SNOWVEX™ and its service providers against third-party claims arising directly from your unlawful use of the Services or your material violation of these Terms.
This obligation does not apply to the extent that the claim results from SNOWVEX™'s own breach of applicable law, negligence, intentional misconduct or other circumstances for which SNOWVEX™ cannot legally require indemnification.
Nothing in this section limits mandatory consumer rights.
SECTION 19 – SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law and the remaining provisions will remain in effect.
Where applicable law requires a different interpretation or modification of a provision, that provision will be interpreted or modified only to the extent necessary to comply with the law.
SECTION 20 – WAIVER; ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision.
These Terms, together with the policies expressly incorporated into them, constitute the agreement governing your use of the Services, subject to any mandatory rights provided by applicable law.
Nothing in these Terms prevents a consumer from relying on rights or remedies provided by mandatory consumer protection legislation.
SECTION 21 – ASSIGNMENT
You may not transfer your contractual rights or obligations under these Terms where such transfer is prohibited by applicable law.
SNOWVEX™ may transfer or assign its rights and obligations where permitted by law, provided that such transfer does not reduce your mandatory consumer rights.
SECTION 22 – GOVERNING LAW AND CONSUMER RIGHTS
These Terms are generally governed by the laws applicable to SNOWVEX™'s place of establishment, without prejudice to mandatory consumer protection laws that apply in the country or region where you reside.
If you are a consumer in Canada, Mexico, Chile, Spain or another jurisdiction with mandatory consumer protection legislation, nothing in these Terms is intended to deprive you of protections that cannot legally be excluded by contract.
Canada
Consumer contracts may be subject to applicable federal, provincial and territorial laws. Certain provinces and territories have specific rules governing internet sales contracts, cancellations, refunds, warranties and consumer disclosures.
Nothing in these Terms limits rights granted to you under applicable Canadian consumer protection legislation.
Mexico
Purchases made by consumers in Mexico are subject to applicable Mexican consumer protection laws, including the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor).
Where applicable, consumers retain statutory rights relating to information, cancellation, refunds, warranties, delivery and complaints.
Nothing in these Terms is intended to waive those rights.
Chile
Purchases made by consumers in Chile are subject to applicable Chilean consumer protection legislation, including Law No. 19.496 and any amendments or successor legislation applicable at the time of the transaction.
Consumers retain mandatory statutory rights concerning electronic purchases, information, delivery, warranties, refunds, cancellations and other remedies.
Where Law No. 21.719 becomes effective, its applicable provisions will also be respected.
Spain and European Union
For consumers located in Spain or another EU/EEA jurisdiction, applicable mandatory consumer protection laws apply.
For online purchases, consumers may have a statutory right of withdrawal of 14 days, subject to applicable legal exceptions.
Consumers also benefit from mandatory legal guarantees and conformity remedies for defective or non-conforming goods.
Where applicable EU or national law provides rights that are more protective than these Terms, those rights prevail.
Nothing in this section prevents a consumer from bringing a claim before a court or authority where mandatory law grants that right.
SECTION 23 – HEADINGS
The headings used in these Terms are included for convenience only and do not affect the interpretation of the provisions.
SECTION 24 – CHANGES TO THESE TERMS
You can review the most current version of these Terms on this page.
We may update, modify or replace these Terms from time to time.
Material changes will be communicated where required by applicable law.
Changes will apply from the effective date stated in the updated Terms and will not retroactively reduce rights that have already arisen under applicable law.
Your continued use of the Services after changes become effective may constitute acceptance of the updated Terms to the extent permitted by law.
